Most landlords will be aware that since 2018 the regulations for the minimum energy efficiency standards (MEES) are that a building with an F or G grade EPC cannot enter into a new lease.
However, many landlords are unaware that from 1st April 2023, new legislation comes in effect where it will be illegal to continue to let properties which do not meet the minimum E threshold (unless a specific exemption applies). The result of this would mean that the rental income must stop until the building is suitably upgraded and a new EPC is registered.
It is the landlord’s obligation to ensure that the building meets the minimum EPC requirements and that improvements are made before the deadline. Whilst the obligations to make these improvements do not fall to the tenant, the costs of carrying out the work may be passed onto the tenant under service charge provisions depending on the terms of their lease.
We recommend that if you own an F or G grade building, it is important that you take action now to meet the new EPC regulations.
